Bulgaria's Prosecutors’ College refuses to replace acting Prosecutor General

Borislav Sarafov will remain Acting Prosecutor General of Bugaria. The Prosecutors’ College of the Supreme Judicial Council unanimously decided not to consider the request by the caretaker Minister of Justice Andrey Yankulov to appoint a new acting chief prosecutor.
The decision was justified on the grounds that the minister does not have the authority to refer such a request to the college and that there is already a final decision from June 2023 appointing Sarafov as acting prosecutor general until a permanent holder of the post is elected.
According to members of the college, the legal uncertainty does not stem from the prolonged tenure of Sarafov, but from legislative changes and the delayed election of a new Supreme Judicial Council, which is responsible for electing a prosecutor general.
Justice Minister initiates procedure to replace chief prosecutor
Yankulov stated that he would consider whether to challenge the decision before the Supreme Administrative Court.
